Terms of Service
The terms that apply when you buy from Cruz Creative: orders, delivery, revisions, refunds and your rights.
Last updated: 14 October 2026
These Terms of Service (โTermsโ) govern all purchases made through cruzcreative.net (the โSiteโ). Cruz Creative is the trading name of James Leslie Tucker, a self-employed (autรณnomo) professional based in the Canary Islands, Spain (โCruz Creative,โ โwe,โ โusโ). By purchasing any service through the Site, you (โyou,โ โthe clientโ) agree to these Terms.
If you donโt agree with any part of these Terms, please donโt complete a purchase. Contact us at hello@cruzcreative.net first and weโll talk it through.
1. Who we are
Cruz Creative is a social media and video content agency. It is not a registered company: itโs the trading name of James Leslie Tucker, operating as a self-employed (autรณnomo) professional, NIF Y6201919Y. Team members and collaborators who deliver work under the Cruz Creative name do so on James Leslie Tuckerโs behalf.

Address: Calle Mรฉndez Nรบรฑez 88, 38001 Santa Cruz de Tenerife, Spain
2. Business clients only
All our services are sold exclusively to businesses and professionals buying for the purposes of their trade, business or profession. We do not sell to consumers.
By completing a purchase, you confirm that you are buying for business purposes. At checkout or before we issue your invoice, you must provide your full legal or business name, tax identification number and registered address. We may cancel and refund an order if we cannot confirm that you are a business.
Because all purchases are business purchases, the consumer right of withdrawal under EU and UK consumer law does not apply.
3. Services and delivery
We sell fixed-scope professional services (video editing, AI video, content strategy, copywriting, design, consulting calls and landing page builds) as listed on the Site. Each product page states its price and estimated delivery time.
Every order is tailored work. Each project is produced individually by our team for your brief, using professional judgement and, where relevant, AI and other software tools. None of our services are automated or delivered by software without human involvement. Finished work is delivered to you by email or download link.
The delivery clock starts when we receive your completed brief, not when you pay. After purchase, weโll email you a short brief form. Your stated delivery time (e.g. โ48 hours,โ โ5 business daysโ) begins counting from the moment you submit that brief, because we canโt start production without it. Business days are Monday to Friday, excluding public holidays in Tenerife.
If you donโt submit a brief within 14 days of purchase, weโll follow up. If we still havenโt received it within 30 days of purchase, weโll cancel your order and refund it in full.
Delivery times are estimates for a complete, on-time brief. They may extend if you request changes to the brief after submission, or if a service depends on information or access only you can provide (e.g. hosting access for a landing page).
4. Revisions and acceptance
Unless the product page says otherwise, every order includes one round of revisions. Revisions donโt apply to consulting calls. A round of revisions is one list of changes sent in a single message. Revision requests must relate to the brief you submitted. New requests outside the original scope may be quoted as a separate order.
You have 7 calendar days from delivery to request your revision. If we donโt receive a revision request within that time, the deliverable is considered accepted. The same 7-day window applies to the revised version.
5. Payment and tax
Payments are processed securely through Stripe. Prices are shown in the currency on the product page or at checkout (EUR, GBP or USD). Payment is taken in full at the time of purchase. We donโt store your card details: Stripe handles that directly.
Our services are provided from the Canary Islands to business clients established outside the Canary Islands. They are therefore not subject to IGIC and are invoiced without IGIC or VAT, with the note: โOperaciรณn no sujeta a IGIC โ art. 17 Ley 20/1991. Inversiรณn del sujeto pasivo.โ You are responsible for accounting for any VAT, sales tax or other tax due in your own country under the reverse-charge or similar mechanism. If you are established in the Canary Islands, IGIC will be added at the applicable rate.
Any bank, currency conversion or payment fees charged by your own bank or card provider are your responsibility.
6. Cancellations and refunds
Before you submit your brief: you can cancel and receive a full refund at any time before you submit the intake brief that starts production. Email hello@cruzcreative.net and weโll process it.
After you submit your brief: submitting the brief starts production, and we schedule and begin work on your order. From that point, payments are non-refundable, except as set out below and in Section 10.
After delivery: because these are custom services delivered to your specification, we donโt offer refunds once a deliverable has been delivered and accepted (see Section 4), other than through the revision policy. If somethingโs genuinely wrong with what we delivered (it doesnโt match your brief, or thereโs a quality issue), tell us within the 7-day acceptance window. Weโll fix it or, if we canโt, refund the affected order.
If weโre the ones running late: if your delivery time passes and we havenโt delivered or been in touch, contact us. If we canโt complete your order within a reasonable extended window, youโre entitled to a full refund.
Chargebacks: if somethingโs not right, please contact us before filing a dispute with your bank or card provider. Weโd rather sort it directly, and itโs faster for you too.
7. Your responsibilities
Delivery times and quality depend on you providing what we ask for in the brief (footage, brand assets, access and answers) accurately and on time. Delays or gaps in what you provide may extend your delivery time accordingly.
8. Materials you send us
You confirm that you own, or have permission to use, any material you send us for your order (such as footage, photos, logos, music, scripts and brand assets).
If a claim is made against us because you sent material you didnโt have the rights or consent to use, you will cover the resulting losses, costs and reasonable legal fees.
We use your material only to produce your order.
9. Ownership and usage rights
Once an order is paid in full and delivered, you own the final deliverable. You may use it for any lawful purpose, including commercial use, advertising and social media, worldwide and without time limit. Any third-party elements (such as licensed music, stock footage or fonts) remain subject to their own licence terms.
Cruz Creative retains the right to showcase completed work (before/after results, excerpts, testimonials) in our own portfolio and marketing, unless you tell us in writing at hello@cruzcreative.net that youโd like your project kept private.
10. Work we donโt accept
We may decline, pause or stop any order that, in our reasonable judgement, involves or would produce any of the following:
Sexual content: pornography, nudity or sexually explicit material, and any sexual or sexualised content involving minors, which we will also report where the law requires.
Violence and harm: content that promotes, glorifies or incites violence, terrorism, self-harm, eating disorders or cruelty to animals.
Hate and harassment: content that attacks or demeans people based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or age, or that bullies, threatens or harasses anyone.
Impersonation and deepfakes: content that uses a real personโs face, voice or identity without their consent, makes it look as if a real person said or did something they didnโt, or suggests a celebrity or public figure endorses a product when they donโt.
Misleading content: false or misleading advertising, fake reviews or testimonials, unrealistic income or โget rich quickโ promises, and unproven health, medical, weight-loss or financial claims.
Disinformation: fake news, or content designed to mislead the public on health, science, elections or current events.
Political content: political or electoral advertising, or campaigning for or against a party, candidate or referendum.
Intellectual property infringement: using footage, music, images, characters, logos or brands you donโt have the rights to, or copying another creatorโs or brandโs work or style in a way that infringes their rights.
Illegal or high-risk products and activities: illegal drugs, weapons, unlicensed gambling, counterfeit goods, scams, pyramid schemes, or any product, service or activity that is illegal where the content will be published.
Privacy and defamation: content that reveals someoneโs private information without their consent, or makes false and damaging claims about a person or business.
Content that is harmful to children: content aimed at children that is inappropriate for them, or that collects their data or targets them with advertising in breach of the law.
Platform and tool rules: content that breaks the rules of the platform where it will be published, or the terms of the AI and software tools we use to produce it.
We may also decline any order that we reasonably believe could harm our reputation, or that we canโt deliver to our usual standard. We donโt have to give a detailed reason.
Refunds when we decline: if we decline an order before we start work, weโll refund it in full. If we stop an order after work has started because the brief or materials you gave us didnโt make the problem clear, payments for the work already done are non-refundable.
11. Extra terms for Custom AI Video and other AI-generated content
This section applies, in addition to the rest of these Terms, to any service that uses AI tools to create video, images or voice, including Custom AI Video.
Likeness and voice. If you send us photos, video or voice recordings of any person, including yourself, you confirm that you have their consent to use them for your order, including to create an AI avatar or voice from them. Section 8 applies if that consent is missing. We wonโt create content that imitates a real person without their consent.
Deleting your source material. We delete source photos and recordings within 90 days of delivery unless you ask us to keep them.
Copyright in AI content. The law on copyright in AI-generated content is still developing, and in some countries content created mainly with AI may not be protected by copyright. We therefore donโt guarantee that AI-generated deliverables can be registered or enforced as copyright works, or that they are exclusive to you.
Labelling. Where platform rules or the law require AI-generated content to be labelled, youโre responsible for labelling it when you publish.
12. Liability
Cruz Creative isnโt liable for indirect or consequential losses arising from use of our services (for example, the performance of content we deliver once itโs published by you). Our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under Spanish law, such as liability for fraud or wilful misconduct.
13. Data protection
We process personal data in line with the EU General Data Protection Regulation (GDPR) and Spanish data protection law. Details are in our Privacy Policy.
14. Governing law
These Terms are governed by the laws of Spain. Any dispute will be handled exclusively by the courts of Santa Cruz de Tenerife, Spain.
15. Language
These Terms are available in English and Spanish. If there is any difference between the two versions, the English version prevails.
16. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time of your purchase applies to that order. Weโll post the current version here with its last-updated date.
